Public Hearing- Road Closure- Pilot Mound

Being a By-law of the Municipality of Louise to close a municipal road and transfer of land.  

WHEREAS The Municipal Act provides, in part, as follows:

290(1)  ‘Subject to subsection (2), a municipality may close a municipal road by

a)      Passing a By-law closing the road; and

b)      [repealed] S.M. 2018, c. 29, s. 26;

c)      Registering the approved By-law and a plan at the appropriate Land Titles office.

AND WHEREAS the following described municipal road is no longer required for public purposes and it is necessary and desirable and in the public interest that the road be closed. 

NOW THEREFORE, the Council of the Municipality of Louise enacts as follows:

 

1.       That all that portion of the municipal road shown on a plan prepared by Jesse Paul Simon Carels, Manitoba Land Surveyor, certified by him on the 12^th of October 2022 and on deposit with the Morden Land Titles Office as Deposit No 1144/2022 MLTO (hereinafter referred to as Parcel ‘A’ and Parcel ‘B’) be and the same is hereby closed.

2.       That, subject to paragraph 3 herein, all that portion of Parcel ‘A’ and Parcel ‘B’ as shown in Plan ___ (Deposit 1144/2022) in NE ¼ 9-3-11 WPM originally being part of Plan 54483 MLTO in NE ¼ 9-3-11 WPM be so closed, and Parcel “A” EXCEPTING thereout all mines and minerals and other matters as reserved in the Crown Lands Act, shall be transferred to the registered owner of the adjacent land which adjacent land is described as:
   

Parcel “F” Plan ___(MLTO) (Deposit No. 263/2025) in the NE ¼ 9-3-11 WPM

and such Parcel “A” shall be consolidated with the title to issue containing Parcel “F” Plan ___(MLTO) (Deposit No. 263/2025) in NE ¼ 9-3-11 WPM, but such transfer shall be subject to the owner of Parcel “F” Plan ___ (MLTO) in NE ¼ 9-3-11 WPM entering into a statutory easement in favour of the Municipality of Louise for a right-of-way to access and maintain the sewer facilities on Parcel “A” of Plan ___ MLTO (Deposit 1144/2022) in NE ¼ 9-3-11 WPM which statutory easement shall be filed in the same series as the transfer.

3.       That the proper officers of the Municipality are hereby authorized and directed to do all acts and execute all documents required for the purpose of implementing the said closing and transfer.
